The products sold on www.secretroomsexyshop.com are marketed online and distributed by Elio Magari, Fraz. Casabianca 111, VAT 01026610053 (hereinafter also simply referred to as “EM”).
These General Terms and Conditions of Sale apply exclusively to purchases made through the website www.secretroomsexyshop.com.
EM may modify the Terms and Conditions of Sale at its sole discretion.
The Terms and Conditions of Sale applicable to orders placed via the website www.secretroomsexyshop.com are those in force at the time of the order request.

Article 1 – Definitions
Supplier or Seller: Unless otherwise specified, this refers to Secretroomsexyshop, Frazione Casabianca 111, 14100 Asti, VAT 01026610053.
Platform or Website: The website secretroomsexyshop.com, owned by the Supplier.
User or Visitor: Any individual accessing the website.
Customer or Buyer: The user who makes a purchase on the Site, accepting these General Terms and Conditions of Sale.
Consumer Customer: A natural person acting for purposes not directly related to any professional activity. Retailers and businesses are therefore excluded.
Professional Customer: Traders, wholesalers, retailers, and, in general, professionals purchasing for non-personal use.
Parties: The Customer and the Supplier.
Order: The request form for goods for sale, completed by the Customer via the Site.
Products: The goods offered for sale on the Site under these General Terms and Conditions of Sale.
Price: The consideration for the sale.
Article 2 – Subject Matter
The subject of this contract is the online sale of the products listed on secretroomsexyshop.com by the Supplier to the Customer under the terms and conditions set forth below.
Article 3 – Sale of Products
3.1 Purchase of Products on the Site is permitted to any User aged 18 years or older.
3.2 The User may select the desired Product by adding it to the “cart.” If they wish to add more products, they may do so in the same manner. At any time, the User may view the products in the cart by clicking on “items in your cart” and decide whether to remove them, continue shopping, or proceed to checkout.
3.3 Once product selection is complete, by clicking “proceed to checkout,” the Customer is required to provide shipping and billing details by filling out the form on the relevant page. The Customer undertakes to provide accurate, truthful, and complete data regarding: personal details, contact information, and any other information necessary for order fulfillment.
3.4 The system allows the User to save their details for faster future purchases. In this case, the User will receive login credentials (to be modified upon first access and kept strictly confidential) via the email address provided.
3.5 The system allows the Customer to choose one of the payment methods described in Article 5 and proceed by clicking “continue.”
3.6 Before confirming the order, the Customer must verify all details in the order summary, including the selected product(s), total amount to be paid, and shipping/billing details.
3.7 The Customer may choose to go back if they do not wish to proceed or confirm it by clicking “order with payment obligation.”
3.8 The order is considered binding for the Customer for 10 days. The order is deemed accepted by the Seller upon sending the order confirmation to the email address provided by the Customer during registration on the Site. The Seller reserves the right, at its sole discretion, to accept or reject the Customer’s order without the Customer being entitled to raise any objections. The Seller may refuse or cancel an order in case of:

Incomplete or inconsistent personal data.

Previous payment defaults.

Suspected credit card fraud.

Product unavailability.

Delivery to free trade zones.

Offensive, racist, or otherwise unacceptable customizations.
The Seller may notify the Customer of order rejection or cancellation (via email or phone) at any time, even after subsequent contact by the Customer. The Customer must keep a copy of the order confirmation for any disputes or complaints.
3.9 Products are sold under the terms and conditions published on the Site at the time of the order.
3.10 The contract is considered concluded and binding when the Supplier sends the order confirmation to the Customer’s email address provided during registration.
3.11 Prices and products may change without prior notice, but those published on the Site at the time of order submission will apply.
3.12 For all purchases, including shipping costs, advance payment is required.
3.13 Discounted or promotional products will be clearly identifiable to the Customer during product selection.
3.14 Product images displayed on the Website are for illustrative purposes only. The Seller makes every effort to represent the Products as accurately as possible; however, images, colors, packaging, and certain aesthetic details may slightly differ from the actual product due to the device settings used by the User or updates made by the manufacturer. Such differences shall not be considered a lack of conformity of the Product and shall not entitle the Customer to complaints or replacement requests, except where required by applicable law.
3.15 Any updates, modifications, or restyling of the Products by the manufacturer shall not be considered an error, discrepancy, or non-conforming product compared to the order placed. The delivered Product may present aesthetic or packaging differences compared to the images shown on the Website, provided that such variations do not affect its nature, functionality, or essential characteristics.
Article 4 – Delivery Times and Methods
4.1 The Supplier delivers both within Italy and internationally. Products are shipped via express courier to the address specified by the Customer.
4.2 Estimated delivery time is 30 days from order confirmation. However, delivery times may vary depending on product availability at the Supplier’s premises. The Supplier will inform the Customer of any delays. These times are indicative and not binding.
4.3 Due to agreements with the courier, no deliveries are made on Saturdays, Sundays, or Italian/national holidays.
4.4 The Seller reserves the right to split deliveries into multiple shipments at its discretion.
4.5 Delivery is made without prior appointment. The courier will attempt delivery twice. If unsuccessful, the products will be held at the courier’s warehouse for 5 working days. If not collected within this period, the order will be automatically canceled, and the products returned to the Supplier at the Customer’s expense.
4.6 Upon delivery, the Customer (or a designated third party) takes physical possession of the products. For Consumers, the risk of loss or damage transfers upon receipt. If the courier was chosen by the Consumer (not the Seller), the risk transfers upon handover to the courier.
4.7 For non-Consumers, all risks transfer upon delivery to the courier.
4.8 Upon delivery, the Customer must verify that the packaging is intact, undamaged, and unaltered. If damage is evident, the Customer may refuse delivery at no cost. Once the delivery document is signed, no claims regarding external product characteristics may be raised.
Article 5 – Customer Obligations
5.1 The Customer must provide all required purchase details and verify their accuracy before submitting the order.
5.2 The Customer must pay the product price and keep a copy of the purchase confirmation sent by the Supplier.
5.3 The Customer must verify packaging integrity upon delivery and promptly report any damage.
Article 6 – Price and Payment
6.1 Prices are in Euros (€) and include VAT.
6.2 The total price includes shipping costs. Additional charges due to failed delivery (e.g., storage fees) are the Customer’s responsibility.
6.3 The Customer acknowledges the full price before submitting the order.
6.4 Payment can be made via:

6.5 The Customer who selects credit card or PayPal will be redirected to the payment provider’s platform to complete the transaction by clicking “pay now.”
6.6 Price changes do not apply to confirmed orders.
Article 7 – Force Majeure
7.1 Neither party is liable for delays caused by unforeseeable circumstances beyond their control (e.g., natural disasters, wars, strikes, terrorism, government actions). The affected party is entitled to an extension of deadlines.
Article 8 – Right of Withdrawal
8.1 Under Articles 52 et seq. of Legislative Decree 206/2005 (Consumer Code), Consumer Customers may withdraw from the contract within 14 days without justification, returning the products for a refund or replacement.
8.2 The right of withdrawal applies only to natural persons acting for non-professional purposes (retailers/businesses are excluded).
8.3 To withdraw, send an explicit declaration to ordini@secretroomsexyshop.com within 14 days.
8.4 The withdrawal period expires:

For single goods: 14 days after physical receipt.

For multiple goods in one order: 14 days after receipt of the last item.
8.5 Products must be returned unused, in original packaging with labels intact. The Customer is liable for value loss due to improper handling.
8.6 Return shipping costs are the Customer’s responsibility (unless defective/wrong item).
8.7 Refunds will be issued via the original payment method within 10 working days of return receipt.
8.8 Refunds may be withheld until product return/verification.
8.9 Non-compliant returns will be sent back at the Customer’s expense.
8.10 No withdrawal is allowed for:

Opened/used products

Custom-made/personalized items
-
Products damaged by the Customer
8.11 NO RETURNS ACCEPTED FROM SWITZERLAND OR NON-EU COUNTRIES.
8.12 NO RETURNS/EXCHANGES FOR DISCOUNTED ITEMS (OVER 30% OFF).
Article 9 – Warranty
9.1 Products sold to Consumers are covered by a 24-month warranty for conformity defects, provided they are used correctly. Defects must be reported in writing within 2 months of discovery.
9.2 Manufacturer warranties (if any) apply as per product documentation.
9.3 If a defect is not covered by warranty, the Customer bears verification/repair costs.
9.4 For defective products, the Seller will repair/replace the item or offer a price reduction/contract termination at no cost.
9.5 If unable to repair/replace, the Seller may refund the full price or provide an equivalent/superior product.
9.6 No compensation is due for repair/replacement delays.
9.7 For non-Consumers, the warranty is 12 months from delivery, with defects to be reported within 8 days.
Article 10 – Privacy
10.1 Personal data is processed in compliance with EU Regulation 2016/679 (GDPR) and Italian Legislative Decree 196/2003 (as amended).
10.2 The Customer acknowledges the Privacy Policy (available on the Site).
Article 11 – Final Clauses
11.1 This Contract constitutes the entire agreement between the parties.
11.2 Any derogations must be in writing and signed by both parties.
11.3 If a clause is deemed invalid, the remaining provisions remain in full force.
11.4 Failure to enforce a right does not waive future enforcement.
11.5 The Customer may not transfer rights/obligations without the Supplier’s written consent.
Article 12 – Communications
12.1 All communications must be in writing (including email) to the addresses specified in the order.
Article 13 – Language
13.1 The contract is drafted in Italian. In case of discrepancies, the Italian version prevails.
Article 14 – Governing Law and Jurisdiction
14.1 The contract is governed by Italian law.
14.2 Disputes shall be settled in the Courts of Brescia, except where consumer protection laws mandate otherwise.
