The products sold on www.secretroomsexyshop.com are marketed online and distributed by Elio Magari, Corso Savona, VAT No. 01026610053 (hereinafter also simply referred to as “EM”).
These General Terms and Conditions of Sale apply exclusively to purchases made through the website www.secretroomsexyshop.com.
EM may modify the Terms and Conditions of Sale at its discretion.
The Terms and Conditions of Sale applicable to orders placed through the website www.secretroomsexyshop.com are those in force at the time the order request is submitted.

Article 1 – Definitions
Supplier or Seller: unless otherwise indicated, refers to Secretroomsexyshop, Corso Savona, 14100 Asti, VAT No. 01026610053.
Platform or Website: the website secretroomsexyshop.com, owned by the Supplier.
User or Visitor: any person who accesses the website.
Customer or Purchaser: the user who makes a purchase on the Website, accepting these General Terms and Conditions of Sale.
Consumer Customer: an individual acting for purposes unrelated to any professional activity. Resellers and businesses are therefore excluded.
Professional Customer: traders, wholesalers, resellers and, in general, professionals who purchase for non-personal use.
Parties: the Customer and the Supplier.
Order: the request form for the goods offered for sale, completed by the Customer through the Website.
Products: the goods offered for sale on the Website in accordance with these General Terms and Conditions of Sale.
Price: the purchase price.
Article 2 – Subject Matter
The subject matter of this contract is the online sale of the products listed on secretroomsexyshop.com by the Supplier to the Customer according to the terms and conditions set out below.
Article 3 – Sale of Products
3.1 The purchase of Products on the Website is permitted to any User who is at least 18 years old.
3.2 The User may select the desired Product by adding it to the “cart”. If the User wishes to add additional products, they may do so in the same way. At any time, the User may view the contents of the cart by clicking on “items in your cart” and decide whether to remove them, continue shopping or proceed to checkout.
3.3 Once the product selection has been completed, by clicking on “proceed to checkout”, the Customer must enter the shipping and billing information by completing the form on the relevant page. The Customer undertakes to provide accurate, truthful and complete information: personal details, contact information and any information necessary to process the order.
3.4 The system allows the User to save their information for faster future purchases. In this case, the User will receive login credentials (to be changed upon first use and kept confidential) at the email address provided.
3.5 The system allows the Customer to choose one of the payment methods described in Article 5 and proceed by clicking “continue”.
3.6 Before confirming the order, the Customer must verify all information in the summary: selected product(s), total amount to be paid, shipping and billing information.
3.7 The Customer may go back if they do not wish to proceed or confirm the order by clicking on “order with obligation to pay”.
3.8 The order is considered binding on the Customer for 10 days. The order is deemed accepted by the Seller when the order confirmation is sent to the email address provided by the Customer during registration. The Seller reserves the right, at its discretion, to accept or reject the order without the Customer being able to object. The Seller may reject or cancel an order in the event of:
Incomplete or inconsistent personal information.
Outstanding previous payments.
Suspected credit card fraud.
Product unavailable.
Delivery to free-trade zones.
Offensive, racist or unacceptable customizations.
The Seller may notify the rejection or cancellation of the order (by email or telephone) at any time, even following subsequent contact from the Customer. The Customer must retain a copy of the order confirmation for any potential disputes.
3.9 The products are sold under the conditions published on the Website at the time of the order.
3.10 The contract is deemed concluded and binding upon the sending of the order confirmation to the Customer’s email address.
3.11 Prices and products may change without notice, but the prices and products published at the time the order is submitted shall apply.
3.12 For all purchases, including shipping costs, advance payment is required.
3.13 Discounted or promotional products will be clearly identified during selection.
3.14 The images of the Products displayed on the Website are for illustrative purposes only. The Seller undertakes to represent the Products as accurately as possible; however, the images and colors displayed may differ slightly from the actual product due to the settings of the device used by the User or possible graphic updates to the product by the manufacturer. Such differences do not constitute a lack of conformity of the Product.
3.15 Any updates, modifications or redesigns of the Products by the manufacturer do not constitute an error, discrepancy or non-conformity of the product with respect to what was ordered. The Product delivered may have aesthetic or packaging differences compared to the images displayed on the Website, provided that such variations do not alter its nature, functionality or essential characteristics.
Article 4 – Delivery Times and Methods
4.1 The Supplier delivers to Italy and abroad. Products are shipped by express courier to the address indicated by the Customer.
4.2 The estimated delivery time is 2–5 business days for Italy and Europe, and 5–10 business days for destinations outside Europe. However, delivery times may vary depending on the destination country, product availability from the Supplier and the courier’s delivery times. Any significant delays will be communicated to the Customer. The delivery times indicated are to be considered indicative and non-binding.
4.3 Due to the agreements with the courier, deliveries are not made on Saturdays, Sundays or Italian national holidays.
4.4 The Seller may divide the delivery into multiple shipments at its discretion.
4.5 Delivery takes place without an appointment. The courier will attempt delivery twice. If unsuccessful, the products will be held in storage for 5 business days. If they are not collected, the order will be cancelled and the goods returned to the Supplier at the Customer’s expense.
4.6 Upon delivery, the Customer (or an appointed third party) takes physical possession of the products. For Consumers, the risk passes upon receipt. If the courier is selected by the Consumer (and not by the Seller), the risk passes when the products are handed over to the courier.
4.7 For non-Consumers, all risks pass upon delivery to the courier.
4.8 Upon delivery, the Customer must verify that the packaging is intact and undamaged. If damaged, the Customer may refuse delivery at no cost. Once the delivery document has been signed, it is no longer possible to dispute external damage.
Article 5 – Customer Obligations
5.1 The Customer must provide all necessary information and verify its accuracy before submitting the order.
5.2 The Customer must pay the product price and retain the purchase confirmation.
5.3 The Customer must verify the integrity of the packaging upon delivery and report any damage.
Article 6 – Price and Payment
6.1 Prices are in Euros (€) and include VAT.
6.2 The total price includes shipping costs. Any additional costs due to failed delivery (e.g. storage fees) shall be borne by the Customer.
6.3 The Customer is informed of the total price before submitting the order.
6.4 Payment may be made via:

Credit card
6.5 The Customer who chooses credit card or PayPal will be redirected to the payment platform to complete the transaction by clicking “pay now”.
6.6 Price changes do not apply to orders that have already been confirmed.
Article 7 – Force Majeure
7.1 Neither party shall be liable for delays caused by unforeseeable events beyond its control (natural disasters, wars, strikes, terrorism, government measures). The affected party shall be entitled to an extension of the applicable deadlines.
Article 8 – Right of Withdrawal
8.1 Pursuant to Articles 52 et seq. of the Italian Consumer Code, Consumer Customers may withdraw from the contract within 14 days without giving any reason, returning the products for a refund or replacement.
8.2 The right of withdrawal applies only to individuals purchasing for non-professional purposes.
8.3 To exercise the right of withdrawal, an explicit statement must be sent to secretroomsexyshop@gmail.com within 14 days.
8.4 The withdrawal period expires:
For a single item: 14 days from receipt.
For multiple items in the same order: 14 days from receipt of the last item.
8.5 Products must be returned unused, in their original packaging and with labels intact. The Customer is responsible for any decrease in value resulting from improper handling.
8.6 Return shipping costs shall be borne by the Customer (except in the case of a defective or incorrect product).
8.7 Refunds will be made using the same payment method within 10 business days from receipt of the returned goods.
8.8 Refunds may be suspended until the returned goods have been inspected.
8.9 Non-compliant returns will be shipped back to the Customer at the Customer’s expense.
8.10 The right of withdrawal cannot be exercised for sealed goods that are not suitable for return for reasons of hygiene or health protection, where the seal has been opened after delivery (e.g. personal hygiene products, underwear, items that come into direct contact with intimate areas). The right of withdrawal remains valid for these products if they are received with the packaging and seal still intact and unopened.
8.11 RETURNS FROM SWITZERLAND OR FROM NON-EU COUNTRIES ARE NOT ACCEPTED.
Article 9 – Warranty
9.1 Products sold to Consumers are covered by a 24-month warranty for defects in conformity, provided they are used correctly. Defects must be reported within 2 months of discovery.
9.2 Manufacturer warranties (if any) apply as specified in the relevant documentation.
9.3 If the defect is not covered by the warranty, inspection and repair costs shall be borne by the Customer.
9.4 For defective products, the Seller will repair/replace the item or offer a price reduction or withdrawal from the contract.
9.5 If repair/replacement is not possible, the Seller may refund the full price or provide an equivalent or superior product.
9.6 No compensation shall be due for delays in repair/replacement.
9.7 For non-Consumers, the warranty period is 12 months, with defects to be reported within 8 days.
Article 10 – Privacy
10.1 Personal data is processed in accordance with the GDPR (EU Regulation 2016/679) and Legislative Decree 196/2003.
10.2 The Customer acknowledges the Privacy Policy available on the Website.
Article 11 – Final Provisions
11.1 This contract constitutes the entire agreement between the parties.
11.2 Any amendments must be made in writing and signed by both parties.
11.3 If any clause is invalid, the remaining clauses shall remain valid.
11.4 Failure to enforce a right shall not constitute a waiver of that right in the future.
11.5 The Customer may not transfer rights/obligations without the Supplier’s written consent.
Article 12 – Communications
12.1 All communications must be made in writing (including by email) to the addresses indicated in the order.
Article 13 – Language
13.1 The contract is drafted in Italian. In case of ambiguity, the Italian version shall prevail.
Article 14 – Cookies
14.1 This website uses technical cookies, which are necessary for the operation of the website, and — subject to your consent — analytics and profiling/marketing cookies.
14.2 Technical Cookies
Necessary for the operation of the website (e.g. cart, login, security). They do not require consent.
14.3 Analytics Cookies
They help us understand how visitors use the website, in aggregate form.
14.4 Marketing/Profiling Cookies
Used to show you personalized advertising based on your activity on the website and on other websites.
14.5 Consent Management
You can accept, reject or modify your preferences regarding non-technical cookies at any time through the cookie banner available on the website.
Article 15 – Applicable Law and Jurisdiction
15.1 The contract is governed by Italian law.
15.2 Any disputes shall fall under the jurisdiction of the Court of Brescia, without prejudice to any consumer protection rights.
